Appellant previously brought an appeal in this cause, and this court reversed and remanded with directions that all parties were entitled to a new trial. From an adverse jury verdict, appellant brings this second appeal. Appellees contend that appellant failed to abstract the pleadings and exhibits, submitted an abstract of testimony which was impartial, and argued the facts in her statement of the case. We must agree with appellees, and, in so doing, we find the abstract to be flagrantly deficient in meeting the requirements of Rule 9 of the Rules of the Supreme Court and Court of Appeals, and accordingly we must affirm for non-compliance with that rule.
